Howells - A Spotless Rose

Post by choirmom »

What is the status of the Herbert Howells, A Spotless Rose? It seems to be offline now. Is it available anywhere?

Thank you.

I have a score of "A spotless Rose" by Herbert Howells.

Whether it may be distributed needs to be resolved.

The composition was written in December 0f 1919, so by date of publishing it SHOULD BE
public domain.

Howells lived until 1983

His works are protected until 70 years after his death in Britian and Europe

The work may be legal in the US where the 70 year law is not in effect.

There may be some other copyright reason the score was removed.

I will check on this question and hope to have an update in a week or so.

I guess this score is under copyright, still? :( Such an epic piece... Baritone solo is perfect for my voice - hence want score!

Well, its public domain in Afghanistan and Ethiopia, since they don't have copyright protections at all.

It will only be PD in the US if and only if:
a) it was first published before 1923, or
b) it was first published between 1923 and 1963 and the copyright was both correctly registered and renewed after 28 years.

In most other jurisdictions (about 90% of the world follows 50/60/70 year terms after the author’s death) the work is under copyright for many years yet (between two and four decades more, minimum).

Och well, I probably won't be alive then, but nevermind; £2 for a score seems reasonable anyway...
